Rent to Own Terms and Conditions for FL Studio Software

 

1. Introduction & Object

These Rent-to-Own Terms and Conditions (“RTO Terms”) form a part of the Image Line Terms of Use entered into between Image Line and you, and are Specific Terms as provided in section 3.6 of the ToU. The ToU will govern these RTO Terms, all capitalized terms used but not defined herein will have the meaning given to them in the ToU.

These RTO Terms govern the FL Studio Rent-to-Own program ("RTO Program") provided by Image Line, the proprietor and operator of the FL Studio Software. By enrolling in the RTO Program, you ("User") agree to abide by these RTO Terms, which form a binding agreement between you and Image Line. This RTO Program allows Users to procure a monthly license to certain FL Studio Software programs for the duration of the chosen RTO Program, at the end of which the monthly license will be automatically converted to a perpetual license in accordance with these RTO Terms.

2. Enrollment and Eligibility

2.1. By enrolling in the RTO Program, you confirm that the information provided is accurate and up to date.

2.2. The RTO Program is available only for select FL Studio Software products as designated by Image Line, not all Software may be eligible.

2.3. Image Line reserves the right to refuse participation in the Program at its discretion.

3. Payment Schedule

3.1. For the duration of the RTO Program, you may procure monthly licenses to the relevant FL Studio Software product for which you must pay the monthly license fee as provided in the order.

3.2. Fees for the monthly license, will be automatically charged to your provided payment method each month for the duration of the RTO Program.

3.3. The total payable amount and number of fees will be clearly displayed before enrollment.

3.4. Failure to make timely fee payments will result in suspension of access to the Software and/or termination of these Terms.

4. Ownership and License Activation

4.1. For the RTO Program duration, Image Line allows you to procure monthly licenses to the FL Studio Software product, where Image Line grants the User, a monthly personal, limited, non-exclusive, non-transferable, non-rentable, worldwide and revocable license, being the right to use the Software and if applicable relevant user manuals, as a single person who uses the Software personally on one or more computers or workstations. The Software is licensed, not sold.

4.2. A perpetual license to the Product will be granted to the User only after the end of the RTO Program duration, during which you have made all monthly license fee payments that were not affected by any refunds, chargebacks or other payment deficiencies.

4.3. Prior to completion of the RTO Program duration, certain usage restrictions may apply to the FL Studio Software, including but not limited to restrictions on transfers, upgrades, or certain features.

5. Cancellation and Consequences

5.1. The User may cancel participation in the RTO Program at any time in their ‘my account’ section of the Website or by creating a support ticket.

5.2. If the RTO Program is cancelled before the end of the RTO Program duration:

  • The User's Software license will remain active until the end of the current billing month, after which it will automatically terminate;
  • No further licensed access to the Software will be provided (notwithstanding to any applicable grace period provided at Image Lines discretion);
  • The Software will revert to Trial Mode.
  • Previously made payments are non-refundable.
  • You will not receive a perpetual license to the Software.

5.3. Image Line reserves the right to terminate or suspend a User’s participation in the RTO Program upon breach of these RTO Terms and ToU, non-payment, fraudulent activity, or as required by law.

6. Responsibilities of the User

6.1. Users are responsible for ensuring that payment information is accurate and up to date.

7. Miscellaneous

7.1. Image Line reserves the right to change or discontinue the RTO Program at any time, with reasonable notice to Users.

7.2 Image Line shall have the right to amend, modify or alter the present RTO Terms. These new RTO Terms will enter into force thirty (30) days after they have been published on the Website. If the User does not agree to these new terms, the User will have to notify Image Line within this timeframe and the User’s license will be revoked when the timeframe expires.
